Privacy notice
This notice explains how we handle personal data when we act for a creditor and when you use our platform.
Template notice for review. It must be checked against the Data Protection Act, 2012 (Act 843) and confirmed by a qualified adviser before publication.
1. Who we are
Eniclic Recover Ghana provides receivables management and debt recovery services. Where we act on instruction from a creditor, that creditor determines the purpose of processing and we process personal data on their behalf under contract. Where we operate our own platform accounts and analytics, we act in our own right.
2. Data we process
Identity and contact details; account and balance information; payment records; correspondence and call notes; dispute and complaint records; device and log data from use of the platform; and, where you tell us, information about your financial circumstances or vulnerability.
3. Why we process it and our lawful basis
To locate and contact customers about outstanding balances, to verify identity, to take and reconcile payments, to administer arrangements, to investigate disputes, to comply with legal obligations, and to improve service quality. We rely on performance of a contract, compliance with legal obligations, legitimate interests in recovering lawfully owed sums, and consent where required — for example for certain marketing.
4. Who we share data with
The original creditor; payment providers; trace, communications and technology suppliers acting under contract; professional advisers and instructed legal partners; and regulators or courts where required by law. We do not sell personal data.
5. International transfers
Some suppliers process data outside Ghana. Where that happens we require appropriate contractual safeguards and confirm that the arrangement meets applicable legal requirements.
6. Retention
We keep account records for as long as needed to resolve the account and afterwards for the period required by law, regulatory expectation and the defence of legal claims. Records are then deleted or anonymised.
7. Your rights
You may ask for access to your personal data, correction of inaccurate data, deletion where the law allows, restriction of processing, and objection to processing based on legitimate interests. You may also complain to the Data Protection Commission.
8. Security
Access to account data is role-based and logged. Platform data is encrypted in transit, and administrative access is restricted to staff who need it for their duties.
